ADVOKAT Pengertian Advokat berasal dari UU Nomo 18 tahun 2003 Pada 05 April 2003 tentang Advokat, didalam kententuannya pasal 1 ayat1 ada penjelasan advokat berisi “Advokat adalah orang yang berprofesi memberi jasa hukum, baik di dalam maupun di luar pengadilan yang memenuhi persyaratan berdasarkan ketentuan Undang-Undang ini.”Pasal 78 Peraturan Pemerintah PP Nomor 36 Tahun 2021. Profesi Advokat harus mempunyai izin beraca di pengadilan berupa kartu anggota Advokat dan Berkas Acara Menjadi Advokat wajib memenuhi syarat-syarat tertulis di dalam pasal 3 ayat 1 UU Advokat isinya Untuk dapat diangkat menjadi Advokat harus memenuhi persyaratan sebagai berikut warga negara Republik Indonesia; bertempat tinggal di Indonesia; tidak berstatus sebagai pegawai negeri atau pejabat negara; berusia sekurang-kurangnya 25 dua puluh lima tahun; berijazah sarjana yang berlatar belakang pendidikan tinggi hukum sebagaimana dimaksud dalam Pasal 2 ayat 1; lulus ujian yang diadakan oleh Organisasi Advokat; magang sekurang-kurangnya 2 dua tahun terus menerus pada kantor Advokat; tidak pernah dipidana karena melakukan tindak pidana kejahatan yang diancam dengan pidana penjara 5 lima tahun atau lebih; berperilaku baik, jujur, bertanggung jawab, adil, dan mempunyai integritas yang tinggi.” PENASIHAT HUKUM Pasal 1 ayat 13 UU No. 8 Tahun 1981 Tentang Hukum Acara Pida KUHAP, penasihat hukum adalah seorang yang telah memenuhi syarat berdasarkan undang-undang untuk memberikan bantuan hukum kepada masyarakat. Mahkamah Agung menerbitkan Surat Edaran No. 8 Tahun 1987 tentang Penjelasan dan Petunjuk-Petunjuk Keputusan Bersama Ketua Mahkamah Agung dan Menteri Kehakiman tanggal 6 Juli 1987 No. KMA/005/SKB/VII/1987 dan No. M. Tahun 1987. Sehingga dahulu penasihat hukum terbagi dalam dua, yakni para pengacara advokat yang sudah diangkat oleh Menteri Kehakiman dan memperoleh izin untuk melakukan kegiatan praktek hukum di manapun. para pengacara praktek yang telah mendapatkan izin dari Ketua Pengadilan Tinggi untuk melakukan praktek hukum di dalam daerah hukum Pengadilan Tinggi bersangkutan. Setelah diberlakukannya UU Advokat maka tidak ada perbedaan mengenai istilah konsultan hukum, advokat, kuasa hukum dan penasihat hukum. Dengan adanya UU tersebut semua istilah berubah menjadi 1 yaitu Advokat. Jumlah responden Survei Kantor Hukum Indonesia 2021 ini terus meningkat mencapai 42% dibandingkan dengan tahun sebelumnya. di tahun 2021 ini, jumlah responden sebanyak 141 kantor hukum dengan rincian 101 kantor hukum memilih identitas sebagai corporate law firm dan 40 kantor hukum merupakan litigation law firm. Sedangkan pada tahun 2020 lalu, jumlah respondennya sebanyak 99 kantor hukum. Salah satu kantor hukum yang berdiri di tahun 2022 yaitu IFANO RAHADIAN LAW OFFICE yang didirikan oleh Ifano Rahadian Pada tahun 2022 Bertempat di Yogyakarta. Masyarakat pencari keadilan pasti gak asing dengan istilah Lembaga Bantuan Hukum alias LBH. Menurut pengalaman pribadi aku, istilah LBH lebih populer daripada kantor advokat atau firma hukum. Banyak yang mengira bahwa kantor advokat/firma hukum dan LBH itu sama. Bahkan sampai sekarang, banyak juga yang mengira markas besarnya klikhukum adalah kantor LBH, duh jian. Meskipun serupa, tapi kantor advokat/firma hukum dan LBH itu gak sama loh. Ini dia perbedaannya, cekidot. 1. Dasar hukum Kantor advokat dan LBH itu diatur dalam undang-undang yang berbeda. Kantor advokat tentu saja didirikan oleh advokat. Nah, advokat itu diatur dalam UU No. 18 Tahun 2003 Tentang Advokat. Oh ya, advokat juga tunduk juga pada Kode Etik Advokat. Berdasarkan ketentuan Pasal 1 Angka 1 UU Advokat, advokat itu adalah orang yang berprofesi memberi jasa hukum, baik di dalam maupun di luar pengadilan yang memenuhi persyaratan berdasarkan ketentuan Undang-Undang Advokat. Jadi kalo kamu butuh penasehat hukum, pendamping hukum, cuzzzlah minta bantuan dari advokat. Kamu bisa konsultasi dan mencari solusi atas permasalahan hukum yang kamu alami. UU Advokat tidak mengatur secara khusus tentang kantor advokat. Meskipun gak diatur secara khusus, tapi untuk menjaga profesionalitas dan sebagai alamat surat menyurat, advokat umumnya memiliki kantor advokat. Yang jelas sih, ketentuan Pasal 5 Ayat 2 UU Advokat menyatakan bahwa wilayah kerja advokat itu meliputi seluruh wilayah Indonesia. Jadi gak ada larangan seorang’ advokat punya kantor di setiap provinsi di Indonesia, hahahaha asal sanggup. Selanjutnya LBH itu diatur dalam UU No. 16 Tahun 2011 Tentang Bantuan Hukum. Oh ya, untuk LBH yang ikut verifikasi dan akreditasi juga harus memenuhi ketentuan Permenkumham No. 3 Tahun 2013 Tentang Tata Cara Verifikasi dan Akreditasi Lembaga Bantuan Hukum atau Organisasi Kemasyarakatan. LBH merupakan salah satu lembaga yang bertugas untuk memberikan bantuan hukum. Pasal 1 angka 3 UU Bantuan Hukum menjelaskan bahwa, pengertian bantuan hukum adalah jasa hukum yang diberikan oleh pemberi bantuan hukum secara cuma-cuma kepada penerima bantuan hukum. Jadi kalo mengacu pada pengertiannya, maka lembaga bantuan hukum itu seharusnya memberikan bantuan hukum secara cuma-cuma kepada kliennya. 2. Biaya Jasa Alias Honorarium Satu perbedaan yang paling terlihat di antara kedua jenis kantor hukum ini adalah pada segi biaya. Untuk para pencari keadilan yang tidak mampu, jika ingin mendapatkan bantuan hukum secara cuma-cuma alias free, monggo minta bantuan ke LBH, terutama LBH yang sudah ikut verifikasi dan akreditasi bantuan hukum. Umumnya sih free, karena sudah ada anggaran dari negara. Tapi tentu aja ada syarat dan ketentuan berlaku ya. Jadi untuk LBH yang sudah ikut verifikasi dan akreditasi bantuan hukum, biaya jasa bantuan hukum akan dibebankan kepada Anggaran Pendapatan dan Belanja Negara. Selain biaya tersebut, sumber pendanaan bantuan hukum dapat berasal dari hibah atau sumbangan dan/atau sumber pendanaan lain yang sah dan tidak mengikat diatur dalam di Pasal 16 UU Bantuan Hukum. Nah, jika LBH yang memberikan bantuan hukum tersebut masih meminta atau menerima uang untuk transportasi ataupun biaya jasa untuk mendampingi perkara, maka hal itu diancam pidana penjara paling lama 1 satu tahun atau denda paling banyak lima puluh juta rupiah. Ketentuan ini sih, diatur dalam Pasal 20 UU Bantuan Hukum. Beda dengan LBH, maka kantor advokat memang sifatnya lebih komersil. Ya wajar dong, namanya juga pekerjaan. Lagian ketentuan Pasal 21 UU Advokat juga mengatur kok, kalo advokat itu mendapatkan honorarium atas jasa hukum yang diberikan kepada kliennya. Kantor Advokat berhak menerima honorarium atas jasa hukum yang diberikan kepada klien sesuai dengan kesepakatan dan ditetapkan secara wajar berdasarkan kemampuan dan kepentingan klien. Jadi jangan heran kalo ada advokat yang bayarannya mahal banget, tapi ada juga advokat yang bayarannya rendah banget. Oh ya, UU Advokat dalam Pasal 22 Ayat 1 juga mengatur bahwa advokat wajib memberikan bantuan hukum secara cuma-cuma kepada pencari keadilan yang tidak mampu. Advokat dianjurkan untuk memberi bantuan hukum secara cuma-cuma setidaknya 50 jam kerja setiap tahun. Nah, itulah alasannya kenapa ada juga kantor advokat yang memberikan bantuan hukum secara gratis alias cuma-cuma. 3. Pendiri Kantor advokat ya jelas dong didirikan oleh seorang advokat. Advokat adalah orang yang sudah mempunyai berita sumpah dari pengadilan tinggi. Kalo advokatnya bisa perang sendiri dan sanggup jadi single fighter, maka boleh aja mendirikan kantor seorang diri. Kalo advokatnya seneng berkumpul dan kerja bersama-sama, maka boleh juga bergabung dengan rekan advokat lain dan membentuk firma. Kalo bahasa kerennya kantornya disebut firma hukum alias law firm. Gimana dengan LBH? Nah, kalo pendiri LBH sih, gak harus advokat. Cuma memang biasanya LBH didukung oleh para advokat, ahli hukum, bahkan juga mahasiswa jurusan hukum yang berstatus magang. 4. Bentuk Lembaga Seperti yang sudah dijelaskan sebelumnya, kantor advokat itu bisa perorangan, persekutuan ataupun firma, tergantung pendirinya. Sedangkan untuk LBH, lembaganya berbentuk yayasan. 5. Ruang Lingkup Pekerjaan Kantor advokat itu ibarat unit usaha atau perusahaan, jadi kantor advokat itu ruang lingkup pekerjaannya lebih luas. Jika memang SDM-nya mumpuni, kantor advokat gak cuma sekadar memberikan jasa non litigasi dan litigasi pendampingan sidang di pengadilan. Kantor advokat keren juga biasanya menyediakan jasa retainer, legal due diligence, de el-de el, kaya layanan jasa yang disediakan oleh Rumah Hukum. Nah, sedikit berbeda dengan kantor advokat, umumnya LBH lebih fokus pada kegiatan memberikan bantuan hukum untuk pencari keadilan, baik di dalam maupun di luar persidangan. LBH juga biasanya rajin melakukan penyuluhan dan sosialisasi. Gimana, meskipun mirip, ternyata cukup banyak perbedaan kantor advokat dan LBH. Btw, sekadar intermezo, banyak orang berpikir bahwa lebih enak menggunakan jasa LBH karena gratis. Eh tapi, perlu dipahami dulu bahwa ada syarat dan ketentuan berlaku untuk mendapatkan bantuan hukum cuma-cuma alias gratis dari LBH. Secara filosofis LBH memang diperuntukkan bagi orang-orang yang benar-benar miskin dan tak mampu membayar jasa advokat. Jadi buat orang yang mampu, awas loh, jangan pura-pura miskin biar dapet bantuan hukum gratis. Tar miskin beneran gimana.~~~ Hajar
Sama-sama menunjang kemajuan dunia bisnis lewat urusan hukum. Beda dalam pertanyaan yang mungkin sering muncul di benak lulusan sarjana hukum Mana yang lebih ringan, bekerja di corporate law firm atau menjadi in house counsel? Jawabannya tentu tidak hitam-putih. Ada dua karier yang biasa diincar sarjana hukum di sektor bisnis. Pertama, sebagai in house counsel penasehat hukum di perusahaan. Kadang ada yang menyebutnya corporate counsel, legal officer, atau legal staff. Perusahaan lain menyebut dalam bahasa Indonesia seperti staf bagian strukturalnya bisa berjenjang dari tingkat junior, senior, dan pimpinan perusahaan. Misalnya mulai dari staf pelaksana, manajer, hingga direktur atau wakil direktur. Intinya, mereka memastikan perusahaan beroperasi sesuai standar kepatuhan terhadap hukum yang berkarier di firma hukum alias law firm yang khusus menangani klien dunia bisnis atau sering disebut corporate law firm. Di sana juga ada jenjang karier yang biasa digunakan. Bagaimanakah cara mendirikan law firm ? Pertanyaan ini sering singgah dalam kepala seorang calon sarjana hukum atau calon advokat. Dan ketika calon sarjana hukum atau calon advokat itu sudah menjadi sarjana hukum atau advokat, maka soal bagaimana mendirikan law firm firma hukum makin dibutuhkan jika advokat bersangkutan ingin menjalani profesi hukum dibawah sebuah badan sebelunya, apakah yang dimaksud dengan law firm firma hukum ? Apakah firma hukum sama dengan kantor hukum, kantor advokat ? Pertanyaan ini jawabannya tergantung pada kedudukan status dari kantor advokat itu. Dalam kaitan ini sebuah firma hukum tidak ada bedanya dengan firma-firma lainnya sebagai sebuah badan usaha. Perbedaan antara firma hukum dengan firma lainnya hanya terletak pada jenis usahanya, dimana firma hukum lebih merupakan badan usaha yang bergerak dibidang jasa hukum yang dijalankan dibawah nama bersama. Dan karenya pendirian firma hukum sama saja dengan pendirian firma pada umumnya dan keberadaannya secara hukum juga tunduk pada ketentuan Pasal 16 Kitab Undang-Undang Hukum Dagang KUHD.Oleh karena itu firma hukum sama dengan firma lainnya, maka syarat minimal pendiriannya sama dengan pendirian firma pada umumnya, yakni didirikan dengan syarat-syarat antara lain;Didirikan dengan suatu akta otentik yang dibuat dihadapan notaris; Akta pendirian harus didaftarkan dalam register yang telah ditentukan untuk itu oleh Kepaniteraan Pengadilan Negeri dalam daerah hukum Kantor Hukum tersebut berkedudukan; Akta pendirian yang telah didaftarkan tersebut harus diumumkan dalam Berita Negara. Seperti telah dijelaskan sebelumnya, bahwa firma hukum pada prinsipnya adalah termasuk dalam arti sebagai persekutuan perdata Maatschap merujuk pasal 1681 KUHPerdata dan seperti dijelaskan pula dalam pasal 1 angka 4 Kepmenhukham Nomor Tahun 2004, dimana firma hukum eksistensinya sama dengan persekutuan perdata yang berebntuk firma. Sebagai persekutuan perdata yang berbentuk firma, fimar hukum law firm harus didirikan oleh sedikitnya dua orang berdasarkan perjanjian dengan Akta pendirian firma sebagaimana dikemukakan di atas, tentu juga dikarenakan belum ada ketentuan khusus yang mengatur badan usaha untuk profesi advokat. Artinya belum ada pengaturan khusus yang mengatur dalam advokat menjalankan profesinya apakah secara induvidual atau bersama-sama, apakah dalam bentuk persekutuan perdata seperti firma atau dalam bentuk Kantor Hukum, Kantor Hukum dan sebagainya. Meskipun demikian, menjalan profesi hukum advokat dibawah badan usaha yang berbentuk firma, tentulah tidak sama dengan menjalankan dalambentuk Kantor hukum atau kantor advokat yang bisa jadi dijalankan secara induvidual. *** dh-1
